HUMAN RIGHTS ACTIVISTS SUED FRANK OKIYE OVER THE PURPORTED DECLARATION OF 14 CONTENDING LEGISLATORS.

Human Rights Activist-Kola Edokpayi in Suit No B/189/OS/2019 filed at the Edo State High Court takes Frank Okiye,Edo State House of Assembly  and ors., to Court  seeks the setting aside of the purported declaration of 12 Members Elect Seat and 2  purportedly Sworn in Members Seat Vacant .

Benin Based Human Rights Activist and the Convener of the Talakawa Parliament-Marxist Kola Edokpayi has sued Frank Okiye.

The Edo State House of Assembly and others ,through his Counsel -Douglas Ogbankwa Esq., over the purported declaration of 14 contending Legislators /Legislators Elect Seats Vacant.

The Suit questions the legality of the action of Frank Okiye and others as it wants an interpretation of Section 109(1)F ,of the Constitution of the Federal Republic of Nigeria,1999 (As Amended),whether it is applicable to Members Elect ,in view of the fact that Section makes reference to Members and not Members Elect .

In a written address prepared by the Plaintiff's   Counsel -Douglas Ogbankwa Esq., flowing from issues distilled from the originating summons ,the Plaintiff questions the legality of the actions of the Defendants against the 14 affected Subjects , in view of the provisions of Section 36 (1) and (2) of the Constitution of the Federal Republic of Nigeria,1999 ( As Amended ),which provides for fair hearing in such  circumstance and the Decision in Usman v. Kaduna State House of Assembly (2007) part 1044 NWLR,which set aside a similar action in  Kaduna State ,bordering on the Kaduna State House of Assembly.
