THE EDO APC CRISIS AND THE INEC STATEMENT---------A CRITICAL REVIEW by FERDINAND OJIEMEN ESQ

The Facebook has been inundated since Friday, with different or divergent opinions, because INEC announced that, it will only accept the lists of party candidates from the national chairmen and executives of the political parties.

We must however note the followings from the statement. First, INEC did not by that statement make the Chairman the sole administrator of his political party.

So, an interested chairman in an internal dispute like Oshiomhole, could be asked to step aside by a court order. Thank God INEC alluded to the possibility of obeying a court order to vary the statement.

 The Obaseki camp should go to court to make Oshiomhole step aside in respect of the Edo elections. Second, the statement from INEC emanated from administrative policy which is not backed by statutory laws, though constant litigations were cited as the reasons behind the policy.

 Since it is a mere policy statement, it can be varied at anytime.

Third, Oshiomhole as the national chairman of APC has no immunity and therefore can sue and be sued, provided the Obaseki camp quickly activates the internal mechanism of crisis resolution in accordance with the APC constitution.

The APC constitution may however be limited in scope here, since an external body like INEC shall be involved in the suit.

 Howbeit, for those jubilating on behalf of Oshiomhole, it is not yet Uhuru. Ferdinand Ojiemen Esq.
