Court discharges man, 52, accused of attempt to have carnal knowledge of another man

Benin, June 5, 2020 (NAN) An Ogbeson
Chief  Magistrates’ court in Benin on Friday discharged man, Mike  Aibueku, 52,  on a charge of an attempt to have carnal knowledge of another man.

The  Chief Magistrate, Prince Mutairu Oare,
dismissed the charge following the police prosecutor, Insp Charity Asemota's request for withdrawal of the charge against the defendant.

Prince Oare however, held that he discharged the defendant of the two count charge not on merit.

At the resumed hearing of the case on Friday,  Asemota urged the court to dismissed the case as the complainant, Mr Omele Friday  had   applied for  the withdrawal of the charge against the defendants.

The complaint told the court that “I do not want to continue with the case because the defendant is a family member and that they have settled.

The prosecutor had arraigned the defendant on two count charge of attempt to commit unnatural offence and conduct himself in a manner likely to cause a breach of the peace.

Asemota  alleged that on June 2, 2020, along Benin Agbor Road, Benin , the defendant did attempted to have carnal knowledge of the complainant.

Prosecutor also alleged that the defendant conducted himself in a manner likely to cause the breach of the peace by given the  complainant  his breast to suck.

The prosecutor said the offence contravened Sections 215 and 249(D) of the Criminal Code of the defunct Bendel State of Nigeria, 1976, now applicable to Edo.

The first count charge attracts seven years imprisonment, while the second one month respectively, for convicted offender.

However, the defendant pleaded not guilty to the charge. (NAN)I
