CALLS FOR GOVERNMENT INTERVENTION IN THE LEADERSHIP TUSSLE ARISING FROM THE ILLEGAL AND UNCONSTITUTIONAL CONDUCT OF THE ELECTION HELD ON THE 30TH DECEMBER AT TAYO AKPATASON UNIVERSITY AFUZE CAMPUS IN OWAN EAST LOCAL GOVERNMENT AREA EDO STATE.

we want to raise a fundamental issues and to notify the general public and the state government, after series of delibration and consideration from stake holders and chapter president across all tertiary institutions in Nigeria, we finally came to a resolution that the convention held on the 30th of December 2019 at Tayo Akpatason University Afuze Campus is null avoid due to the following reasons.

1. The outgoing president comrade Dirisu  Ariomoh and the out going speaker comrade Iyare Aibangbe did not follow the constitutional process as enshrined in sections 16 and 17 of the constitution to elect or apoint a chairman and members of the electoral body, which is drawn from the final year student's of higher learning mate in all across the country.

2. constitution provides that the outgoing speaker must convene a sitting with the chapter presidents in all tertiary institutions before an election could  be conducted,but the outgoing speaker comrade iyare Aigbangbe failed in that regard and made it unconstitutional. the outgoing speaker and the outgoing president hurried convene to present their choice of comrade Samuel ogbeifun as the president to succeed him even through it was clearing  that they conducted a purported election for their selfish interest.

3. the outgoing speaker single handed printed tags for unidentified things he claimed to be chapter presidents and mobilized them for the election to manipulate the result for their preferred candidate.
we are condemning the act of the outgoing speaker as fraudulent because it involves forgery which resultant effect is jail term.
After much manipulation the outgoing president and the outgoing speaker forced the unconstitutional electoral committee chaired by igafe Daniel to declare comrade Samuel ogbeifun as the winner of the election, the election was characterized by fraud,

therefore the APC stake holders chapter presidents,members of this great union across all tertiary institutions of
National Association of Edo State Student's (Naess) National, therefore declared it as null avoid and unconstitutional,since illegality cannot bring legality in an election wrongly conducted to bring in comrade Samuel  ogbeifun as factional president,

We are appealing to the state Government Governor Godwin Obaseki  to disregard whoever may would Parade himself as the new exco at the influence of the outgoing National president comrade Dirisu Ariomoh as election cannot be held with the NRC  senators on watsapp processes.

CONCLUSION

A. the electoral chairman which was nominated by the outgoing National president does not meet up with the constitutional provision as it is clearly stated in

SECTION 16:
ELECTORAL COMMINSSION SUB SECTION 3
which state  "the chairman and members  of the electoral committee shall be a final year student's and penultimate year student's respectively and as such he doesn't have the constitutional power to declare result.

B . there was no sitting held by the outgoing speaker in any of the tertiary institutions within Nigeria were the speaker was supposed to rectified the electoral nominees nominated by the outgoing president not WATSAPP sitting according to :

which state the meeting of the NRC shall be in any if the tertiary institutions within Nigeria and as such the speaker does not have the constitutional power to choose who vote and who does not vote.

C. the outgoing speaker single handedly printed tags for some people he called chapter president (senators) and brought them to vote and as such some manipulation took place to rub the election we later find out that those persons he gave tags with their pictures on it were not chapter presidents.

D.There was no proper  zoning of some positions the constitution provides for zoning

E. lack of proper screening of candidate by the unconstitutional electoral committee

F. Manipulating of fiqures  and edulging of collecting bribes for exchange of positions by unconstitutional electoral committee

G. Confliction of positions that was supposed to be zoned and also denial of eligible senators access to the convention premises.

We are calling on the state government, governor godwin obaseki to intervene in the leadership tussle arising from the illegal and unconstitutional conduct of the election held on the 30th of December 2019 at Tayo Akpatason University, Afuze Campus in Owan East local Government Area,Edo State
